Conditions of Sale

All prospective bidders MUST be registered.

The form of registration will be made available by the Liguanea Lodge (The Organizers) in its normal promotion and advertising but can be requested of The Organizers during the period May 3 – May 26, 2022.

A bidding number will be assigned and communicated by email upon registration. This number must be used for all bids. No bid will be accepted from a bidder without a bidding number.

Works will be auctioned in the order listed in this catalogue. This Auction is being held virtually, therefore works will NOT be physically available at the auction. All lots will be displayed virtually while the lot is being auctioned.

All works are sold ‘As Is”. The Organizers offer no warranties or representation of the correctness of the catalogue or other description of the physical condition, size and quality of the works.

The Organizers reserve the right to withdraw any lot from the sale.

The Organizers reserve the right to reject any bid.

Lot advances will be at the discretion of the Auctioneer as advised by The Organizers

On the fall of the Auctioneer’s gavel (virtually), ownership passes to the highest bidder acknowledged by the Auctioneer.

Immediately after the fall of the Auctioneer’s gavel, the winning bidder will assume full responsibility for payment by debit/credit card (VISA or Mastercard) on the night of the auction or by bank transfer to the bank account designated by the Organizers, no later than June 3, 2022. Details of the bank account are set out below.

Works must be paid for in full before being surrendered to the purchaser or his/her representative.

All receipts will be sent to the purchaser (the winning bidder) within 48 hours of confirmation of funds in The Organizer’s bank account

Surrender of works will be made in Jamaica to the purchaser or his/her representative once full payment has been confirmed in the The Organizer’s bank account.

Works must be collected by or on behalf of the winning bidder within fourteen (14) days after the auction, after which a storage fee may be charged.

If the winning bidder fails to make payment as stipulated herein, the Organizers shall be entitled to either (i) take action to recover the amount due or (ii) deem the winning bidder as having forfeited his/her right to the Work and resell the Work, without further reference to the winning bidder.

Absentee Bids:

Absentee Bidding will be facilitated. An Absentee Bid Form must be completed and submitted to The Organizers on or before noon on the day preceding the Auction.

Forms are available upon request. The Organizers will assign an agent to try and purchase the lot or lots of your choice for the lowest price possible. On no account will they bid more than the top amount which you indicate. The execution of Absentee Bids are handled by The Organizers as a convenience to bidders who cannot be present at the auction, and will not be responsible for any errors or omissions in connection therewith.

Exclusion of liability for technical failures:

Neither the Auctioneer, the Organizers or any of their representatives will be responsible for errors or failures to execute bids placed virtually on the internet, including, without limitation, errors or failures caused by (i) a loss of connection on the Organizer’s or on the bidder’s end, (ii) a breakdown or problems with the online bidding software, and/or (iii) a breakdown or problems with a bidder’s internet connection, computer or system. The Organizers do not accept liability for failing to execute an online internet bid or for errors or omissions in connection with this activity.
